Trademark Usage

Any right to display and/or use the Badgeville trademarks and logos (the “Badgeville Marks”) pursuant to a Master Software-as-a-Service Agreement (or other similarly titled master agreement for the use of the Badgeville Service) between the applicable Customer (“you”) and Badgeville must be in accordance with the following guidelines:

The Badgeville Marks Include:

  • Badgeville (registered)
  • The Behavior Platform (registered)
  • Badgeville logo (unregistered, application pending)
  • Engagement Layer (unregistered, application pending)
  • Reputation Mechanics (registered)
  • Social Context (unregistered, application pending)
  • Social Currency (unregistered, application pending)
  • Social Mechanics (registered)

Authorization Terms & Instructions

You may only use the Badgeville Marks to the extent authorized in a separate agreement executed by you and Badgeville. In addition, your use of the Badgeville Marks is subject to, and you must comply with, the following terms, and any other commercially reasonable instructions provided by Badgeville, in using any Badgeville Marks:

  1. 1. You must not obscure or otherwise alter the appearance of any Badgeville Mark in any way. Changing the color, font, or proportions of any Badgeville Mark is prohibited, as is removing any legend (e.g., ® for registered trademarks, TM for unregistered trademarks, and SM for unregistered service marks);
  2. 2. You must not use any Badgeville Mark to disparage Badgeville, its products or services, or in a manner which, in Badgeville’s reasonable judgment, may diminish or damage its goodwill in the Badgeville Mark or imply endorsement or certification by Badgeville of any of your products or services. You also agree to cease all such uses immediately upon written notification by Badgeville. You agree not to take any action that might lead a third party to think any Badgeville Mark is owned by you, or that might adversely impact Badgeville’s reputation. You must at all times use the Badgeville Marks in a manner consistent with trademark laws;
  3. 3. You must notify Badgeville immediately of any improper, infringing, confusing or unauthorized use of any Badgeville Mark of which you become aware; and
